IMPORTANT! BY COMPLETING THIS ORDER, YOU ARE AGREEING TO TERMS AND CONDITIONS. THIS IS A BINDING LEGAL AGREEMENT. PLEASE READ THESE TERMS AND CONDITIONS OF SERVICE CAREFULLY BEFORE USING THE SERVICE. IF YOU DO NOT AGREE TO THIS AGREEMENT, PLEASE DO NOT COMPLETE YOUR ORDER. WE RESERVE THE RIGHT TO MODIFY OR AMEND THIS AGREEMENT FROM TIME TO TIME WITHOUT NOTICE. YOUR CONTINUED USE OF WEBSITE, PLATFORM OR SERVICE FOLLOWING THE POSTING OF CHANGES TO THIS AGREEMENT WILL MEAN YOU ACCEPT THOSE CHANGES. UNLESS WE PROVIDE YOU WITH SPECIFIC NOTICE, NO CHANGES TO THIS AGREEMENT WILL APPLY RETROACTIVELY.  THIS AGREEMENT CONTAINS MANDATORY ARBITRATION AND REQUIRES ALL LAWSUITS TO BE BROUGHT IN MARION COUNTY, FL. 

Reservations are charged in full at the time of booking.

Participant Requirements - Should be a minimum of 10 years of age. Must weigh between 70 and 270 pounds to zip line and up to 250 lbs. to horseback ride. Participants under the age of 18 must have proper parental/guardian supervision and/or valid permission to participate. Participants under the age of 18 who do not have the required documentation will be denied participation in the tour. Minor must be able to participate independently of the adult Closed toed shoes are required.  You must complete a participation agreement for yourself and/or your minor child in order to participate in any tour/activity offered at The Canyons Zip Line and Adventure Park. No one under the influence of alcohol, illegal drugs or prescription drugs that limit ability will be allowed to participate in the tour. - Long hair should be tied back in a low pony tail (close to the neck). - Hanging jewelry should be avoided. - To participate in this active tour, guests must be in reasonably good health, able to endure short ground hikes, several sets of stairs and maneuver themselves along the cable. - Pregnant women, people with heart, leg or back problems or other serious illnesses should not participate in the tour. Guides have sole discretion to end participation in the event of participants failure to follow guides' instructions or for any other safety concerns on the part of the guide or management.  All participants are expected to arrive 20 minutes prior to their scheduled tour start time. Tours operate rain or shine so please dress appropriately. Participants are required to wear closed toe, closed heal shoes. Other clothing suggestions are long shorts (no short shorts) or pants and shirts with short or long sleeves.

Cancellation Policy: Reservation cancellations and fees are as follows: cancellations received more than 72 hours in advance of the tour time will receive a full refund less $3.00 per person or 3% (whichever is greater) processing fee to cover administrative and/or credit card processing fees.  Cancellations within 72 hours of the tour time are not eligible for a refund.  Be aware, the tours go out rain or shine.  If The Canyons Zip Line & Adventure Park cancels your tour prior to the start of the tour due to inclement weather or any other unforeseen event, we will either refund your payment in full, or issue a raincheck. 

TO CANCEL OR RESCHEDULE, YOU MUST SPEAK WITH AN AGENT DURING REGULAR BUSINESS HOURS OF 9:00 AM TO 5:00 PM, MONDAY THROUGH FRIDAY 352-351-9477.  HOURS ARE SUBJECT TO CHANGE WITHOUT NOTICE.  LEAVE A MESSAGE if an operator is not available so we can record the date and time of your call.

Late Arrivals: No refunds or rescheduling is permitted for late arrivals. If you fail to arrive on time for your activity, the tour seats go empty and we still incur the same expenses and may have turned others away. Tours leave on schedule and it will not be possible to join a tour after it has started.

Taxes and Fees and Payment: State of Florida sales tax 6%; Marion County Tax 1%; Certain features of the Platform, such as booking a reservation or purchasing products may incur a 1.5% processing fee (collectively, “FL plus Local Taxes and Fees”). You must dispute any Fees within 30 days from charging thereof, and any claims not raised within such time are waived by you.

I further agree to save, defend, indemnify, and hold harmless (i.e., defend and pay, including costs and attorneys fees, including appellate proceedings) The Canyons, Inc. DBA The Canyons Zip Line and Adventure Park from any claim or lawsuit by me, or by anyone purporting to act on my behalf, my family, my estate, my heirs, or my assigns, for damages, or loss of data, use or other intangible losses (even if advised of the possibility of such damages) arising directly or indirectly out of use of services.  I intend that this Agreement be enforceable to the fullest extent provided by law, and in the event that any of the terms set forth in this Agreement or any word, phrase, clause, sentence (including without limitation any geographic, temporal or participatory restrictions), part, or provision should be found to be illegal, void, or unenforceable for any reason, such word, phrase, clause, sentence, part, or provision shall be modified or deleted in such manner as otherwise required, in to extend the fullest effects, rights, duties, and protections under this Agreement, as so modified, so that the validity of the remaining words, phrases, clauses, sentences, parts, and provisions shall not be affected thereby and shall be deemed, interpreted, and enforced, as being severable and independent from such illegal, void, or unenforceable provisions, and said illegal or invalid part, term or provision shall be deemed not to be a part of this Agreement and all other valid provisions shall survive and continue to bind the parties, and be interpreted and enforced, as if such illegal, void, or unenforceable provisions were never a part of this Agreement. This Agreement shall be interpreted and enforced according to the laws of the State of Florida, notwithstanding the choice-of-law rules or conflicts of laws principles of this State, or of any other state, territory, province, or nation; and any claim or action relating to, or arising out of, this Agreement, or the recreational activities to which it applies, may be brought only in a court located in, or comprising, Marion County, Florida; and only after participation in a presuit mediation conference, which is a prerequisite condition to bringing suit.
